These terms and conditions apply to the StarlitLoan Personal Loan Application (the "Application") independently developed and operated by Starlit Finance Limited, a Non-Banking Financial Company (NBFC) certified by the Reserve Bank of India (RBI) (hereinafter referred to as "we" or "us"). Please read and fully understand all contents of these terms and conditions before using this Application. By registering as a user or using any services provided by the Application, you agree to be bound by these terms and conditions.
2.1. Loan Services: We provide eligible individual users in India with personal loans of up to ₹100,000 through the StarlitLoan Application. The Annual Percentage Rate (APR) may be as low as 18%, and the loan tenure may be up to 12 months. The specific loan amount, interest rate, and tenure will be determined based on your credit evaluation.
2.2. Repayment Management: The Application offers convenient repayment management features, allowing you to view repayment details and make repayments to ensure timely repayment.
2.3. Customer Support: We provide professional customer support to address any issues or questions you may encounter while using the Application. You can contact us through in-app support channels or email.
2.4. Real-time Progress Notifications: We recognize the importance of transparency in the loan process. Therefore, we provide real-time notifications throughout the entire loan process, from application submission, approval updates, to loan disbursement and repayment reminders. This ensures that you are always updated on the loan status and can take timely actions such as receiving loan funds on time or avoiding late repayment.
3.1. Registration Requirements
- You must be an Indian citizen, at least 18 years old, and possess full legal capacity.
- You must provide accurate, complete, and valid personal information, including but not limited to your phone number, basic identity details, financial information, employment information, and identity documents. You are required to set a secure account password and protect your account and password information.
3.2. Eligibility Review
- We will review the registration information provided, including identity verification and credit evaluation. We may request additional documentation or information to assist with the review process.
- If the information provided is false, incomplete, or non-compliant, we have the right to reject your registration application.
4.1. Application Process
- You must choose the appropriate loan product within the Application, fill out the loan application details, and upload relevant documents such as your ID and PAN card.
- You are required to ensure that the loan application information and documents provided are true, accurate, and complete. If you provide false information or documents, we have the right to reject your loan application and reserve the right to pursue legal action.
4.2. Approval Process
- We will assess your loan application based on the provided information and documents, using our credit evaluation model and risk control policies.
- We may collaborate with third-party credit evaluation agencies to obtain your credit information to assist with the approval. We will comply with all applicable laws and privacy policies to ensure the protection of your personal information.
- We have the right to independently decide whether to approve your loan application and the specific terms, such as loan amount, interest rate, and tenure. The approval result will be communicated to you through notifications within the Application or via SMS.
5.1. Loan Disbursement
- If your loan application is approved, the loan funds will be disbursed to your designated bank account. The disbursement time may vary due to factors such as bank processing time.
5.2. Repayment Methods
- You must repay the loan in accordance with the repayment schedule. Repayment methods include but are not limited to bank transfers and third-party payment platforms. The specific repayment method will be clearly communicated to you within the Application.
- You must ensure sufficient funds in your repayment account before the due date to avoid late repayment fees and negative credit history.
5.3. Late Payment Handling
- If you fail to repay the loan on time, it will be considered overdue. We will charge overdue fees as per the agreement, including but not limited to overdue interest and late fees.
- Late repayment may negatively affect your credit record and impact future loan applications and other financial activities. We reserve the right to take legal action for overdue loans, including engaging third-party debt collection agencies or seeking resolution through legal means.
6.1. Compliance with Laws: You must comply with the relevant laws and regulations of India and the rules of the Application while using the services. You may not use the Application for any illegal activities.
6.2. Provide Accurate Information: You must provide truthful, accurate, and complete registration information, loan application information, and supporting documents. If any information changes, you must update it in the Application.
6.3. Account Security: You must keep your account and password information secure and may not transfer, lease, or lend your account to any third party. If you detect any security risk or unusual activity, you must notify us immediately and follow our instructions to take appropriate actions.
6.4. Timely Repayment: You must make timely and full repayments in accordance with the repayment schedule. If you are unable to make a payment on time due to special circumstances, you must contact us in advance and explain the situation to discuss a solution.
6.5. Protect Personal Information: You must protect your personal information and not disclose sensitive details such as account passwords, ID numbers, or bank account information to third parties. You must also respect others' privacy and refrain from illegally obtaining, using, or disseminating others' personal information.
7.1. Information Review: We have the right to review the registration information, loan application details, and supporting documents submitted by users. If we find that the information is false, incomplete, or non-compliant, we have the right to request additional or corrected information, or reject the user’s registration or loan application.
7.2. Service Adjustment: We have the right to modify or adjust the services, features, or processes of the Application based on business needs, market conditions, or legal requirements. We will notify users of such changes in advance through the Application, SMS, etc. However, in urgent situations, prior notice may not be possible.
7.3. Violation Handling: If a user violates these terms or any other provisions of the Application, we have the right to take appropriate actions, including but not limited to warnings, restricting access to some or all services, suspending or terminating the account, or pursuing legal action.
7.4. Information Usage: We have the right to collect, use, store, and protect your personal information in accordance with the Privacy Policy to provide and improve services, conduct risk assessments, send notifications, and comply with laws and regulations.
We respect and protect users' personal privacy and will strictly adhere to the Privacy Policy (see the Privacy Policy page within the Application) regarding the collection, use, storage, and protection of users' personal information. By using the Application, you agree to the terms of this Privacy Policy.
9.1. Force Majeure: We are not liable for any failure or loss resulting from force majeure events, such as natural disasters, war, government actions, network failures, etc.
9.2. Third-Party Actions: We are not responsible for the actions or services provided by third parties (e.g., banks, payment platforms, credit evaluation agencies). If you have disputes with third parties, you should resolve them directly, though we may offer assistance when necessary.
9.3. Accuracy of Information: While we strive to ensure the accuracy of the information provided, we are not responsible for any loss caused by incorrect, omitted, or outdated information. You should verify and assess the information independently.
9.4. User Fault: We are not responsible for any loss caused by the user’s own fault (e.g., violation of these terms, improper operations, failure to secure account information, etc.).
In case of disputes between you and us regarding these terms, both parties should first attempt to resolve the matter through friendly negotiations. If negotiations fail, either party may initiate legal proceedings in the competent court in India.
11.1. Amendment of Terms: We have the right to modify and update these terms and conditions at any time. The modified terms will be published within the Application and will take effect from the date of publication. Continued use of the Application indicates your acceptance of the revised terms.
11.2. Notification: We may send notifications to users through announcements within the Application, push notifications, SMS, emails, or calls. Users should ensure that the contact details provided are accurate and up to date. Failure to notify us of contact changes may result in the notification being deemed delivered.
11.3. Complete Agreement: These terms and conditions constitute the complete agreement between you and us regarding the use of the Application and supersede any prior verbal or written agreements related to the services provided by the Application.
11.4. Severability: If any provision of these terms and conditions is found to be invalid or unenforceable, it will not affect the validity or enforceability of the remaining provisions, which will continue to apply.
